Method of sale & asking price

Easements & wayleaves

The land is sold subject to and with the benefit of all wayleaves, easements or quasi easements and rights of way, light, support, drainage and services supplies, whether mentioned in these particulars or not and without any obligations to define the same respectively. The vendors are aware of both a water main and foul sewer crossing the site, a plan showing the approximate position of such is available from the selling agents.

Planning

The site is located within the settlement boundary of the village of Hunmanby as defined by the Scarborough Borough Local Plan (2011 – 2032) policies map. The site forms the major part of a wider allocation identified by the Local Planning Authority as site reference HA29. The future development of the site (i.e. the land for sale) should not prejudice the ability of the reminder of the allocation to be brought forward. The site layout prepared by STEN Architects for 29 units demonstrates a potential means of accessing the remainder of the allocation and together shows a buffer strip between the proposed housing and the railway line and the retention of the landscape/tree buffer onto Stonegate.

The STEN layout shows a variety of house types and demonstrates that the site can accommodate this number of dwellings whilst still complying with the issues and requirements text of the site allocation statement. The number of units shown is higher than that quoted in the Local Plan (i.e. 20 across the whole allocation), but this is referred to as an indicative yield, ScarboroughÂ’s benchmark policy being 12.1/units per acre. It is believed that the Local Planning Authority should not rigidly adhere to the figure of 20 given that this was an indicative yield figure only and not the product of any detailed master planning of the site.

Policy H3 – Affordable Housing: “Filey, Humnanby & Southern Parishes” – 15% onsite requirement with 70% affordable rent unless established otherwise. The council will consider, demonstrating through viability the onsite provision requirement, would render a site nonviable, they would consider meaning a reduced level or financial contribution towards offsite provision may be acceptable when accounting for the necessity of developing out the whole of the allocation with the primary access off Stonegate.

Policy HC14 – Open Space: Provision of open space will be required through development in line with the council’s policy as laid out in the councils Greenspace Supplementary Planning Document.

Policy HC10 – Health & Education: The council are likely to seek developer contributions towards health & education from development of the site as per policy guidelines.

In terms of heritage assets, the site does not include any listed buildings or scheduled monuments, nor are there known to be any in the immediate vicinity. The site is not located in a conservation area and is not in an area of medium or high flood risk (as defined by the Environment Agency). Historically, the vendor commissioned a Highway Analysis and this can be provided electronically by request.

Contamination

The vendors and their agents are not aware of any of the land having being filled with any contaminated matter referred to in the Environmental Protection Act 1990, however you should satisfy yourself on this aspect through your own enquiries and investigations.
